{"id":21300,"date":"2026-03-05T08:51:36","date_gmt":"2026-03-05T08:51:36","guid":{"rendered":"https:\/\/nationalgunowner.org\/index.php\/2026\/03\/05\/texas-therapists-will-no-longer-get-away-with-pushing-kids-toward-sex-changes\/"},"modified":"2026-03-05T08:51:36","modified_gmt":"2026-03-05T08:51:36","slug":"texas-therapists-will-no-longer-get-away-with-pushing-kids-toward-sex-changes","status":"publish","type":"post","link":"https:\/\/nationalgunowner.org\/index.php\/2026\/03\/05\/texas-therapists-will-no-longer-get-away-with-pushing-kids-toward-sex-changes\/","title":{"rendered":"Texas Therapists Will No Longer Get Away With Pushing Kids Toward Sex Changes"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div style=\"position:relative\" data-narration-container=\"true\">\n<p><span style=\"font-weight:400\">Psychologists, counselors, and social workers in Texas can be penalized just like doctors for helping facilitate children\u2019s sex changes, according to an opinion clarifying the state\u2019s ban on sex-rejecting interventions.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Texas Behavioral Health Executive Council (TBHEC) asked Republican Attorney General Ken Paxton if mental health providers met the criteria of \u201chealth care provider\u201d described in the state\u2019s child sex-rejection ban, <\/span><a href=\"https:\/\/legiscan.com\/TX\/text\/SB14\/id\/2756089\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight:400\">S.B. 14<\/span><\/a><span style=\"font-weight:400\">, suggesting the care provided by mental health professionals fell outside the outlawed interventions.<\/span><\/p>\n<p><span style=\"font-weight:400\">\u201cThe agency respectfully seeks clarification as to how such providers are impacted by S.B. 14, given that the prohibited activities and services are exclusively medical in nature and fall outside the scope of practice for mental health professionals,\u201d the council wrote in a July 2025<\/span> <a href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/request-files\/request\/2025\/RQ0605KP.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight:400\">letter<\/span><\/a><span style=\"font-weight:400\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight:400\">\u201cAny radical facilitating the \u2018transitioning\u2019 of our kids is committing child abuse. The law is clear that these radical procedures are illegal and in no world should Texans\u2019 tax dollars be used to permanently harm children,\u201d Paxton told The Daily Wire. \u201cThis opinion should send a clear warning that there will be consequences for any medical professional, whether a doctor or a therapist, who is illegally \u2018transitioning\u2019 Texas kids.\u201d<\/span><\/p>\n<p><span style=\"font-weight:400\">The<\/span> <a href=\"https:\/\/bhec.texas.gov\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight:400\">TBHEC<\/span><\/a><span style=\"font-weight:400\"> helps regulate and uphold professional standards within the state\u2019s behavioral health and social service professions.<\/span><\/p>\n<p><span style=\"font-weight:400\">Paxton unequivocally said mental health professionals fell within the criteria of the ban in an<\/span> <a href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/opinion-files\/opinion\/2026\/kp-0518.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight:400\">opinion<\/span><\/a><span style=\"font-weight:400\"> published on February 27, 2026.<\/span><\/p>\n<p><span style=\"font-weight:400\">\u201cThe unambiguous definition of \u2018health care provider\u2019 does not require a prescription pad or scalpel,\u201d Paxton stated in the opinion. \u201cS.B. 14 codified more than a prohibition on providing certain surgeries and prescriptions.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight:400\">Paxton further clarified that the Texas<\/span>\u00a0<a href=\"https:\/\/legiscan.com\/TX\/text\/SB14\/id\/2756089\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight:400\">ban<\/span><\/a><span style=\"font-weight:400\"> on child sex-rejection forbids the use of public money to fund any individual or organization that \u201cprovides or facilitates\u201d the gender transition of minors.<\/span><\/p>\n<p><span style=\"font-weight:400\">The TBHEC told The Daily Wire the professionals they help regulate are \u201cexpected to comply fully with Texas law.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight:400\">\u201cS.B. 14 prohibits certain medical procedures for minors in Texas. The question before us was whether the technical statutory definition of \u2018health care provider\u2019 included behavioral health professionals,\u201d Darrel Spinks, Executive Director of the Texas Behavioral Health Executive Council, told The Daily Wire.\u00a0<\/span><\/p>\n<p><span style=\"font-weight:400\">\u201cOut of deference to the statutory framework and the Attorney General\u2019s role in interpreting state law, we sought formal clarification to remove any ambiguity. The opinion confirms what many would reasonably assume; that licensed mental health professionals are health care providers under the statute. This does not change the law or our responsibilities. Our licensees are expected to comply fully with Texas law,\u201d Spinks stated.\u00a0<\/span><\/p>\n<p><span style=\"font-weight:400\">The council\u2019s letter mentioned the pending Supreme Court case,<\/span> <a href=\"https:\/\/www.dailywire.com\/news\/scotus-to-hear-challenge-to-colorados-gender-identity-censorship-law\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight:400\">Chiles v. Salazar<\/span><\/a><span style=\"font-weight:400\">, where Christian counselor Kaley Chiles is challenging Colorado\u2019s law banning so-called conversion therapy. The Colorado <\/span><a href=\"https:\/\/content.leg.colorado.gov\/sites\/default\/files\/2019a_1129_signed.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight:400\">law<\/span><\/a><span style=\"font-weight:400\"> prohibits counselors from \u201c<\/span><span style=\"font-weight:400\">attempts or purports to change an individual\u2019s sexual orientation or gender identity,\u201d which <\/span><span style=\"font-weight:400\">Chiles argues violates her freedom of speech and pushes children towards sex-rejecting medical interventions.\u00a0<\/span><\/p>\n<p><span style=\"font-weight:400\">\u201cThe court is examining whether the regulated practice of mental health counseling is conduct or speech,\u201d wrote the TBHEC. \u201cCircuit courts are split, as the Third and Eleventh Circuits treat mental health counseling as speech and not conduct, while the Ninth and Tenth Circuits treat it as conduct and not speech. Given the significance of the question before the court, which may have far reaching implications, this case may be something you want to consider in your opinion.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight:400\">Paxton addressed these concerns in the opinion footnotes, writing, \u201cYou also imply that your questions may intersect with the First Amendment, referencing Chiles v. Salazar \u2026 But Chiles concerns a statute that is markedly different from the framework at issue in your request.\u201d\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight:400\">However, Paxton wrote his office generally did not comment on pending litigation and would offer \u201cno speculation on the scope of the Court\u2019s eventual holding in Chiles.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight:400\">Mental health providers play a pivotal role in the sex-rejecting medical intervention pipeline by providing psychological assessments that are often required to obtain sex change surgeries, such as a double mastectomy, the opinion noted.\u00a0<\/span><\/p>\n<p><span style=\"font-weight:400\">\u201cThe multidisciplinary path to medically transitioning children often starts with mental \u2018health care,\u2019\u201d the opinion states. \u201cMental health professionals serve as the \u2018clinical gatekeepers whose assessments and recommendations initiate the interventions\u2019 prohibited by S.B. 14.\u201d<\/span><\/p>\n<p><span style=\"font-weight:400\">Many insurance companies and surgeons require a recent mental health assessment and surgery recommendation<\/span> <a href=\"https:\/\/transcare.ucsf.edu\/surgery-referral-assessment-requirements\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight:400\">letter<\/span><\/a><span style=\"font-weight:400\"> in order to move forward with sex-rejecting surgery.<\/span><\/p>\n<p><span style=\"font-weight:400\">The quality and clinical practice surrounding these assessments were heavily criticized in the Department of Health and Human Services (HHS) 2025 <\/span><a href=\"https:\/\/opa.hhs.gov\/sites\/default\/files\/2025-11\/gender-dysphoria-report.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight:400\">report<\/span><\/a><span style=\"font-weight:400\"> on the treatment of gender dysphoria.\u00a0<\/span><\/p>\n<p><span style=\"font-weight:400\">Leor Sapir, PhD, a Senior Fellow at the Manhattan Institute and co-author of the HHS report, explained how gender clinician assessments often focus on achieving teens\u2019 sex-rejection goals rather than examining their gender dysphoria.\u00a0<\/span><\/p>\n<p><span style=\"font-weight:400\">\u201cGender clinicians have abandoned the assessment model pioneered by the Dutch and replaced it with \u2018readiness assessments\u2019 designed to help kids clarify and pursue their \u2018embodiment goals,\u2019\u201d Sapir told The Daily Wire.\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight:400\">\u201cImportantly, gender clinicians freely acknowledge that these goals can shift, with some claiming that this is not a failure of treatment but rather part of a teen\u2019s \u2018gender journey.\u2019 And increasingly, the gender-focused specialists in the mental health field have come to view assessment in the traditional sense as a form of harmful gatekeeping, or even \u2018conversion therapy.\u2019 \u201c\u00a0<\/span><\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">TODAY: The Texas Supreme Court will hear oral arguments in the case of <a href=\"https:\/\/twitter.com\/SorenAldaco?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">@SorenAldaco<\/a>, an Independent Women ambassador &amp;
