data-narration-container=\"true\">\n<p>The U.S. Supreme Court on Wednesday sharply limited the ability of states to consider race when drawing congressional maps, a decision that could reshape the balance of power in Washington and intensify redistricting battles ahead of the 2026 midterms.<\/p>\n<p>Writing for the majority, Justice Samuel Alito struck down Louisiana\u2019s congressional map, which included two majority-black districts, as an unconstitutional racial gerrymander.<\/p>\n<p>In the court\u2019s <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/24-109_21o3.pdf\" target=\"_blank\" rel=\"noopener\">36-page opinion<\/a>, Alito emphasized that \u201cthe Constitution almost never permits the Federal Government or a State to discriminate on the basis of race,\u201d framing the central <a href=\"https:\/\/www.scotusblog.com\/2026\/04\/in-major-voting-rights-act-case-supreme-court-strikes-down-redistricting-map-challenged-as-racia\/\" target=\"_blank\" rel=\"noopener\">question <\/a>as whether compliance with the Voting Rights Act justifies such actions.<\/p>\n<p>For the court\u2019s conservative wing, the answer was no.<\/p>\n<p>\u201cBecause the Voting Rights Act did not require Louisiana to create an additional majority-minority district, no compelling interest justified the State\u2019s use of race in creating SB8, and that map is an unconstitutional racial gerrymander,\u201d the court\u2019s opinion held.<\/p>\n<p>The ruling stopped short of overturning Section 2 of the Voting Rights Act, but it significantly restricts how states can use race in redistricting, a shift that could weaken a key mechanism for creating majority-minority districts.<\/p>\n<p>\u201cToday\u2019s 6-3 Supreme Court decision in the Callais case is BIG WIN for Equal Protection under the Law, as it returns the Voting Rights Act to its Original Intent, which was to protect against intentional Racial Discrimination,\u201d President Trump celebrated in a <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/116490075773072322\" target=\"_blank\" rel=\"noopener\">Truth Social post.<\/a> \u201cThank you to the brilliant Justice Samuel Alito for authoring this important and appropriate Opinion.\u201d<\/p>\n<p>In a bitter dissent, liberal Justice Elena Kagan warned of sweeping consequences that \u201care likely to be far-reaching and grave.\u201d<\/p>\n<p>\u201cToday\u2019s decision renders Section 2 all but a dead letter,\u201d Kagan wrote. \u201cIn the States where that law continues to matter\u2014the States still marked by residential segregation and racially polarized voting\u2014minority voters can now be cracked out of the electoral process.\u201d<\/p>\n<p>Louisiana will be required to redraw its maps, and other Republican-led states will likely revisit their own districts amid an escalating nationwide redistricting battle.<\/p>\n<p><span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Ryan Girdusky<\/span><\/span>, a conservative political consultant and host of the podcast \u201c<span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">It\u2019s A Numbers Game<\/span><\/span>,\u201d said he expects the White House to pressure Republican-led states to act ahead of the November elections.<\/p>\n<p><span style=\"font-weight:400\">\u201cI think the White House was genuinely caught off guard with how ambitious blue states would be, like California and Virginia, to redistrict their states in retaliation to Missouri and Texas,\u201d <\/span><span style=\"font-weight:400\">Girdusky told The Daily Wire. \u201c<\/span><span style=\"font-weight:400\">And because they are on the losing side of this calculation, as of right now, of this redistricting calculation, and because Indiana failed to redistrict, there\u2019s going to be immense pressure on all southern states to redistrict black, majority, mostly rural districts, into Republican districts.\u201d <\/span><\/p>\n<p>New maps in Louisiana, Florida, Georgia, Alabama, South Carolina, Mississippi, North Carolina, and Tennessee could net Republicans as many as 12 seats in Congress, <a href=\"https:\/\/www.nytimes.com\/2025\/10\/15\/upshot\/supreme-court-voting-rights-gerrymander.html\" target=\"_blank\" rel=\"noopener\">according to a New York Times analysis.\u00a0<\/a><\/p>\n<div class=\"image\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-1086665 size-full aligncenter\" src=\"https:\/\/dw-wp-production.imgix.net\/2026\/04\/current_plausible_720.jpg\" alt=\"\" width=\"719\" height=\"388\" srcset=\"https:\/\/dw-wp-production.imgix.net\/2026\/04\/current_plausible_720.jpg 719w, https:\/\/dw-wp-production.imgix.net\/2026\/04\/current_plausible_720-300x162.jpg 300w\" sizes=\"auto,  (max-width: 719px) 100vw, 719px\"\/><\/div>\n<p>Blue states, including <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">California<\/span><\/span> and <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Virginia<\/span><\/span>, have passed referendums expected to add Democratic seats. The Virginia Supreme Court is currently considering Republican-backed legal challenges.<\/p>\n<p>\u201cIf Virginia cannot redistrict, if Virginia has to go back to its old district lines, and we have a situation where they go back to their old lines, and the South is able to redistrict, it absolutely could be game-changing as far as the midterms go,\u201d Girdusky added.<\/p>\n<p>Democrats sharply criticized the ruling. Democratic National Committee Chair Ken Martin called Wednesday\u2019s ruling a \u201cdark day for America,\u201d arguing the court \u201ceffectively killed Section 2 of the Voting Rights Act, a major step back in the fight for racial justice and fair representation.\u201d<\/p>\n<p>Sen.
