{"id":24505,"date":"2026-05-18T15:11:32","date_gmt":"2026-05-18T15:11:32","guid":{"rendered":"https:\/\/nationalgunowner.org\/index.php\/2026\/05\/18\/luigi-mangione-scores-another-win-as-judge-tosses-out-key-evidence\/"},"modified":"2026-05-18T15:11:32","modified_gmt":"2026-05-18T15:11:32","slug":"luigi-mangione-scores-another-win-as-judge-tosses-out-key-evidence","status":"publish","type":"post","link":"https:\/\/nationalgunowner.org\/index.php\/2026\/05\/18\/luigi-mangione-scores-another-win-as-judge-tosses-out-key-evidence\/","title":{"rendered":"Luigi Mangione Scores Another Win As Judge Tosses Out Key Evidence"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div style=\"position:relative\" data-narration-container=\"true\">\n<p><span style=\"font-weight:400\">A New York judge on Monday tossed out key evidence found in the backpack of Luigi Mangione, the man accused of gunning down UnitedHealthcare CEO Brian Thompson in the heart of Manhattan.<\/span><\/p>\n<p><span style=\"font-weight:400\">Judge Gregory Carro ruled that evidence obtained from Mangione\u2019s backpack when he was arrested at a <\/span><span style=\"font-weight:400\">Pennsylvania McDonald\u2019s must be suppressed, including a <\/span><span style=\"font-weight:400\">magazine, cellphone, passport, computer chip, and wallet.\u00a0<\/span><\/p>\n<p><span style=\"font-weight:400\">A gun and notebook that prosecutors say connect Mangione to Thompson\u2019s murder will still be allowed as evidence at the trial, which is set to begin on <a href=\"https:\/\/www.reuters.com\/legal\/government\/luigi-mangione-due-court-ruling-backpack-evidence-ceo-killing-case-2026-05-18\/\" target=\"_blank\" rel=\"noopener\">September 8 and last about six weeks<\/a>.\u00a0<\/span><\/p>\n<p><span style=\"font-weight:400\">The ruling is a partial win for Mangione\u2019s defense team, who argued that the search of the backpack without a warrant violated his constitutional rights.<\/span><\/p>\n<p><span style=\"font-weight:400\">\u201cAt the hearing, Altoona law enforcement officers repeatedly attempted to justify their warrantless search of Mr. Mangione\u2019s backpack \u2026 instead, all these officers demonstrated was an utter disregard for a defendant\u2019s constitutional rights and a shocking ignorance of basic search and seizure caselaw,\u201d Mangione\u2019s attorneys wrote in a state court filing, <a href=\"https:\/\/abcnews.com\/US\/judge-decide-throw-key-evidence-luigi-mangione\/story?id=133018432\" target=\"_blank\" rel=\"noopener\">according to ABC News.<\/a>\u00a0<\/span><\/p>\n<p><span style=\"font-weight:400\">The prosecution argued the officers acted \u201cin deliberate and painstaking fashion\u201d while searching the backpack.\u00a0<\/span><\/p>\n<p><span style=\"font-weight:400\">\u201cAt every step, the Altoona officers responded to this unexpected and alarming situation reasonably,\u201d Assistant District Attorney Joel Seidemann wrote in a court filing.\u00a0<\/span><\/p>\n<p><span style=\"font-weight:400\">Thompson was gunned down from behind in Midtown Manhattan on December 4, 2024, as he was walking to a hotel during his company\u2019s annual investor conference.\u00a0<\/span><\/p>\n<p>Shell casings retrieved from the scene had the words \u201cdeny,\u201d \u201cdefend,\u201d and \u201cdepose\u201d written on them, according to the New York Police Department. The words found on the shell casings have been connected to a 2010 book that was critical of the health insurance industry. Mangione\u2019s fingerprints allegedly matched fingerprints found on shell casings at the murder scene.<\/p>\n<p><span style=\"font-weight:400\">The killing sparked a massive, nationwide five-day manhunt, which ended with Mangione\u2019s arrest at a McDonald\u2019s in Altoona, Pennsylvania, which is more than 200 miles from Manhattan. At the fast food chain, police found a firearm, suppressor, and what appeared to be a manifesto in his backpack, <a href=\"https:\/\/www.dailywire.com\/news\/doj-drops-fight-for-death-penalty-in-luigi-mangione-assassination-case\" target=\"_blank\" rel=\"noopener\">The Daily Wire previously reported.<\/a>\u00a0<\/span><\/p>\n<p>Mangione pleaded not guilty to the federal and state murder charges. In January, U.S. District Judge Margaret Garnett dismissed two of the four charges, including use of a firearm to commit murder, which made him eligible for the death penalty.<\/p>\n<p>Garnett said she dismissed the charges \u201csolely to preclude the death penalty as an available punishment when the jury determines if the Defendant caused Brian Thompson\u2019s death,\u201d The Daily Wire\u00a0<a href=\"https:\/\/www.dailywire.com\/news\/federal-judge-says-prosecutors-cant-pursue-death-penalty-against-luigi-mangione\" target=\"_blank\" rel=\"noopener\">reported<\/a>\u00a0at the time.<\/p>\n<p>Behind bars, Mangione has amassed a following of mostly Left-wing advocates angry with the American healthcare system.
